2. Description of Services
Otter Tours organizes boat tours, focused on visiting caves and coastal tours in the Algarve.
Important Note: All activities are strictly dependent on weather conditions and sea state. The safety of our passengers and crew is our top priority.
3. Bookings and Payments
- Bookings can be made through our website (via booking widget), email, or phone.
- Prices shown include VAT at the legal rate in force.
- The booking is only considered confirmed after receipt of proof of payment or express confirmation from us.
4. Cancellations and Refunds
By Otter Tours:
We reserve the right to cancel any tour due to:
- Adverse weather conditions or sea state that compromise safety.
- Unforeseen technical breakdowns.
- Failure to meet the minimum number of passengers (if applicable).
In case of cancellation by Otter Tours, the customer will be offered the possibility to reschedule for another date or a full refund of the amount paid.
By the Customer:
- Cancellations made up to 24 hours in advance will be entitled to a full refund.
- Cancellations made less than 24 hours in advance or failure to show up (no-show) at the departure time will not be entitled to a refund.
5. Disclaimer and Safety
By participating in our tours, the customer acknowledges and accepts that:
- Nature of Activity: Boat tours are nature tourism activities that involve inherent risks, including, but not limited to, vessel movement due to waves, sun exposure, and water splashes.
- Safety Instructions: The customer commits to strictly following all safety instructions given by the captain and crew, including wearing life jackets when requested.
- Physical Condition: The customer declares not to have any health restrictions that prevent them from safely participating in the activity. Pregnant women and people with back or neck problems must inform the crew before boarding.
- Personal Belongings: Otter Tours is not responsible for damage, loss, or theft of personal belongings (cameras, phones, glasses, etc.) taken on board. We recommend using adequate protection for electronic equipment against water and salt.
- Behavior: We reserve the right to refuse boarding or interrupt the tour for any passenger who exhibits inappropriate behavior, is under the influence of alcohol or drugs, or endangers the safety of the vessel and other passengers, without right to refund.
6. Insurance
AZIMUTES DE AVENTURAS LDA holds all mandatory insurance required by law for Tourist Animation activities (Personal Accidents and Civil Liability), as required by Turismo de Portugal.
7. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Portuguese law. For the resolution of any dispute arising from the interpretation or execution of these terms, the Court of the District of Faro shall be competent, with express waiver of any other.
